SOME QUESTIONS REGARDING THE SUBSTANCE OF THE OPEN BIDDING APPEAL

The article reveals the essence of contesting open tenders as stages of the open bidding procedure. It has been established that open tenders are one of the key mechanisms for the distribution of state expenditures, and therefore the issue of proper protection of the rights of participants in tender procedures becomes of primary importance both for economic circulation and for ensuring the principles of transparency and competitiveness in the use of budget funds. It has been proven that the stage of contesting open tenders acts as a legal guarantee of compliance with legally established requirements by customers and an effective means of countering corrupt practices and discriminatory terms of tender documentation. It is substantiated that, firstly, in the conditions of full-scale armed aggression against Ukraine and the introduction of martial law, the procedural conditions for conducting open tenders have changed significantly: the Special features of public procurement, approved by Resolution of the Cabinet of Ministers of Ukraine No. 1178 of 10/12/2022, have entered into force, which significantly transformed the terms and procedure of appeals. Secondly, in 2021-2026, the Law of Ukraine "On Public Procurement" No. 922-VIII underwent a number of fundamental changes in terms of regulating the status of appeal subjects and the powers of the appeal body.Thirdly, the judicial practice of recent years shows an increase in the number of disputes regarding the legality of decisions of the Antimonopoly Committee of Ukraine in the field of public procurement, which actualizes the study of the subject composition of appeal relations. It has been established that the appeal of open tenders is a social relationship that arises in the process of appealing open tenders by the subject of the appeal in accordance with administrative legislation to the AMCU of violations on the part of the customer.
