ANALYSIS OF THE EFFICIENCY OF ADMINISTRATIVE AND LEGAL REGULATION OF STATE POLICY ON THE DEVELOPMENT OF SMALL BUSINESS ENTITIES IN THE CONDITIONS OF THE ACTION OF THE LEGAL REGIME OF MARTYR STATE

Abstract

The presented scientific research is devoted to the topical issue – analysis of the effectiveness of administrative and legal regulation of state policy on the development of small business entities under the legal regime of martial law. It is emphasized that the current situation, full of complexity and unpredictability, provides stable support for small business entities. It is shown that the challenges, threats and risks of wartime are not yet significant obstacles to the rejection of the development of various forms of entrepreneurship in Ukraine. A special role, given such circumstances, in this sense, is assigned to a selected group of entities.

It was found that one of the real obstacles to the development of the latter are some shortcomings in terms of administrative and legal regulation mechanisms. Based on this, the need to analyze the effectiveness of the aforementioned regulation, as well as identify urgent discussion positions, was emphasized.

The research identifies the types of regulatory legal acts that contain administrative law norms and collectively form the mechanisms of administrative legal regulation of the specified sphere. For the completeness and comprehensiveness of the work, a personal gradation of the latter is proposed, namely: 1) the Constitution of Ukraine; 2) international treaties (of various subject areas); 3) laws (laws and codes); 4) subordinate regulatory legal acts.

The principles of state legal policy, which are the basis of these mechanisms and guidelines for management approaches when solving subordinate issues, are analyzed. The exceptional role in the corresponding conditional hierarchy of the Law of Ukraine “On the Development and State Support of Small and Medium-Sized Entrepreneurship in Ukraine” is clarified. The active interest of the state in the analyzed measures is proven, which is confirmed by legislative amendments to the represented act.

Key vulnerabilities are identified through the prism of the effectiveness of such regulation during the operation of a special legal regime on the territory of Ukraine. Attention is drawn to the existence of some urgent problems in wartime conditions. Promising steps for their solution are outlined, which should contribute to the development of small business entities by strengthening their potential.
