SPECIAL FEATURES OF THE LEGAL STATUS OF FOREIGN MILITARY PERSONNEL IN THE CONTEXT OF SPECIAL STATE SERVICE

The article is devoted to the analysis of the legal status of foreign military personnel and stateless persons in Ukraine in the context of determining whether they can be considered public servants performing a form of public service of a special nature. The author examines the regulatory framework of military service, as defined in Article 2 of the Law of Ukraine “On Military Duty and Military Service,” which characterizes military service as a special type of public service carried out by citizens of Ukraine, as well as by foreigners and stateless persons.
At the same time, for a considerable period, the existing legislation remained unclear regarding the application of the Law of Ukraine “On Prevention of Corruption” and the regulation of conflicts of interest in relation to foreign military personnel. This legal uncertainty led to numerous inconsistencies in both the regulatory framework and its practical implementation.
The paper provides a detailed analysis of the distinction between the legal status of Ukrainian citizens and foreigners in military service, emphasizing that foreigners may serve exclusively on a contractual basis and only in specifically designated positions and units. The author also examines the position of the National Agency on Corruption Prevention (NACP) regarding the application of anti-corruption legislation, which remained ambiguous for a long time due to the absence of clear legislative provisions on whether requirements related to asset declaration and prevention of conflicts of interest apply to foreign military personnel.
The key conclusion of the study is the analysis of legislative changes introduced by the Law of Ukraine No. 4730-IX of 17 December 2025, which regulated the legal status of foreigners and stateless persons serving in the Armed Forces of Ukraine. This law established their right to temporary residence for the entire duration of the contract and for six months after its expiration (except in cases of early termination), and defined social guarantees related to remuneration, leave, medical care, and medical services for such personnel. The author emphasizes that these legislative changes did not fully address the issue of the application of anti-corruption legislation to foreign military personnel and therefore require further legislative clarification.
